Private Residential Tenancy
Scotland's open-ended tenancy, with no fixed term at all.
The Private Housing (Tenancies) (Scotland) Act 2016 created the private residential tenancy, which has no end date. A tenant can leave on 28 days' notice; a landlord must use one of the statutory eviction grounds and apply to the First-tier Tribunal, not the courts.
The parties are called Landlord and tenant.
What you need to know
- Open-ended — there is no fixed term and no "no-fault" ending
- The tenant gives 28 days' notice; the landlord must use a statutory ground
- Disputes go to the First-tier Tribunal for Scotland (Housing and Property Chamber), not a court
- The Scottish Government model tenancy agreement has mandatory clauses that must be included
- Landlords must be registered with the local authority
Use the official model
This jurisdiction has a model document with clauses that must be included, so use it rather than a generic template.
Scottish Government model private residential tenancy agreement ↗Why we do not offer our own version
Scotland has its own regime with wording that has to be included, and YouRent's tenancy tools currently cover England. Rather than hand you a document that looks official and is not right for where your property is, we point you at the one that is.
Information, not legal advice. Have anything you intend to rely on checked by a solicitor.
