Sharing a kitchen or living room with you makes them an excluded occupier with a licence, not a tenancy. Deposit protection does not apply, and neither side needs a court order to end it.

If you do not live in the property, letting a room creates a tenancy with the full set of obligations: deposit protection, gas and electrical safety, and a statutory ground needed to get it back.
Tenancy agreement →Letting rooms to three or more people from more than one household may make the property a house in multiple occupation, which needs a licence from the council. Check before you advertise — the fines are substantial.
